                                ORDINANCE NO. 9569
                   
                   
                   AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, 
                   PART II, SECTION 18-105 AND 18-123, SO AS TO 
                   IMPOSE A SURCHARGE OF ONE DOLLAR ($1.00) PER 
                   TON ON LANDFILL FEES.
                   
                   
                                                     
                   
                   
       	    	 WHEREAS, Public Chapter No. 451 provides that as of July 
       1, 1991, there shall be imposed a surcharge of $.85 per ton on 
       each ton of municipal solid waste received at all waste disposal 
       facilities to be collected and remitted to the State Treasury.
       	    	 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 
       THE CITY OF CHATTANOOGA, TENNESSEE, That:
       	    	 SECTION 1.  Section 18-105, Chattanooga City Code, Part 
       II, as amended, be and the same is hereby amended by adding 
       thereto a new subsection (d) as follows:
            	 (d)  In addition to the fees imposed provided 
            hereinabove, there shall also be imposed a surcharge of 
            one dollar ($1.00) per ton for each ton of tires 
            received at the landfill.
            
       	    	 SECTION 2.  Section 18-123, Chattanooga City Code, Part 
       II, as amended, be and the same is hereby amended by adding 
       thereto a new subsection (h) as follows:
            	 (h)  In addition to the other landfill fees 
            provided hereinabove, there shall be imposed a surcharge 
            of one dollar ($1.00) per ton for each ton of municipal 
            solid waste received at the landfill.
            
       	    	 SECTION 3.  This Ordinance shall take effect 
       immediately, the public peace, health or safety requiring same, 
       and shall be operative on July 1, 1991, pursuant to the 
       requirements of Public Chapter No. 451.
